Is the USF Unconstitutional? What the Ruling Means for Telecoms

August 2, 2024 By Andrew

Recently, a court ruling by the Fifth Circuit declared the Universal Service Fund (USF) unconstitutional, causing quite a stir in the telecom world. This decision follows a series of failed lawsuits by Consumers Research in other circuits but finally hit the jackpot in the Fifth Circuit. The court’s beef? Two main issues: too many private companies on the USAC board potentially benefiting from the fund, and Congress not giving the FCC enough direction on how to collect contributions for the USF.

Keep Calm and Carry On

So, what does this mean for telecom service providers? We’re not legal experts, so we attended a great webinar hosted by a panel of legal and industry experts, and there’s also a useful article from The CommLaw Group. Here are the key takeaways.

First off, keep calm and carry on—continue paying your USAC bills quarterly. Despite the ruling, it’s business as usual for now. The FCC is likely to appeal to the Supreme Court, and we probably won’t see any real action until after January 2025. So, don’t start counting your legal fee savings just yet.

The Importance of USF Programs

The ruling doesn’t bash the necessity of the programs funded by the USF. The Lifeline program, crucial for rural and underserved areas, the eRate program for schools and libraries, and telehealth services are all still vital. The big worry is the broader economic impact—companies might hit pause on some projects, and the market could feel the tremors.

Congressional Tug-of-War

Now, onto Congress, where things get even more interesting. A bipartisan working group has been trying to come up with a new policy for the past 18 months but is still struggling. Hopefully they’re able to figure it out as a bipartisan issue, because we don’t want the USF to become a political hot potato like Medicare or SNAP.

There’s some talk about changing who pays into the USF. Right now, 34% of the funding comes from telephony, but if broadband and application providers were to chip in that would create a much bigger pool of contributors – and much less burden on traditional telecom companies.

What Should Telecom Providers Do?

So, what should telecom providers do?

  • Keep following the rules and paying those USAC bills.
  • Stay tuned to what’s happening in Congress and be ready to adapt.
  • Assess the potential impacts on your projects and think about alternative funding sources if needed.
  • Advocate for those vital connectivity programs that so many people rely on.

In the end, while this ruling has certainly rocked the boat, staying informed and proactive can help telecom providers navigate these choppy waters. It’s a complex issue, but with a little vigilance and a lot of patience, the industry can weather this storm.
